Harrie Samaras Publishes Third Edition of Book on The Use of ADR In Intellectual Property and Technology Cases

West Chester, Pa. – Harrie Samaras is the co-editor of, and a contributing author to, the book ADR Advocacy, Strategies, and Practices for Intellectual Property and Technology Cases, published by the ABA’s Section of Intellectual Property Law. This updated and expanded version of Harrie’s earlier book provides the guidance, practical knowledge, and practice-tailored language, forms, and appendices necessary to effectively use ADR processes in intellectual property and technology disputes.

In contrast to prior editions, this Third Edition of the book focuses in some areas and expands in others. For example, it coalesces three chapters on mediation from the first two editions that reflected various perspectives on mediation (i.e., magistrate judge, in-house counsel, mediator) into one chapter of practical guidance and tips for participating in IP/Technology mediations. This edition broadens its coverage of various topics (e.g., appellate mediation, domain name disputes, small copyright disputes) to provide additional insights and guidance from multiple appellate mediation programs, multiple administrators of Uniform Domain Name Dispute Resolution Policy (UDRP) cases, and a recently established tribunal for copyright cases.

This book is intended to serve as a practical guide for attorneys (in-house or outside counsel) and business executives whose work requires them to have knowledge and skills in using alternatives to litigation for resolving intellectual property and technology disputes. It comprises strategies, skills, and practices that may be new, improving, or reaffirming. Overall, the aim is for counsel (who represent clients in ADR processes), participants (legal/business) in ADR processes and transactional attorneys (who draft and negotiate pre-dispute resolution clauses) to be more effective at what they do.
